Licensing Terms

Version of

These Licensing Terms govern how a MobiusApp licence is purchased and how you move between plans. They form part of the Terms of Service.

1. Purchasing a licence

1.1. Subscription plans (Start, Business, Pro)

1.1.1. To begin using the platform you pay for a minimum of three months on the plan you choose. That payment also covers preparing, building and publishing the application. Once the work has started or the application has been published to the App Store and Google Play, the three months already paid are not refundable.

1.1.2. To keep using the platform without interruption, you may buy the next licence period no earlier than 30 calendar days before the current one expires. The new period is counted from the day the previous one ends.

1.2. Enterprise

1.2.1. An Enterprise licence is granted for the term set out in the individual agreement and covers deployment inside your own infrastructure, transfer of source code and signing keys, and support under the agreed SLA.

1.2.2. Enterprise terms, including the term itself, renewal and the scope of transfer, are agreed individually and prevail over these Terms where they conflict.

2. Moving between plans

2.1. Subscription plans

2.1.1. You may move to a plan with a higher level of functionality at any time during the licence period. The remaining paid time on the current licence is carried over to the new one, recalculated at the new plan's price.

2.1.2. You may move to a plan with a lower level of functionality by purchasing a licence no earlier than 7 calendar days before the current period ends. Before the move you must switch off any features that the lower plan does not include, and bring your catalogue and locations within its limits — otherwise the move cannot be completed.

2.2. Subscription to Enterprise

2.2.1. Moving from a subscription plan to Enterprise is agreed individually. The unused paid time on the subscription is credited against the Enterprise licence.

3. Limits

3.1. Each plan has limits on the number of products and points of sale, published on the pricing page. Exceeding them requires a move to a higher plan.

3.2. Integrations are not limited by plan: every supported integration type is available on all plans, including Start.

4. Termination and lapse

4.1. If a licence is not renewed, the application stops working for shoppers at the end of the paid period. Data is retained for 30 days, during which the licence can be renewed and the application restored.

4.2. On subscription plans no source code, build artefacts or signing keys are transferred, either during the licence term or after it. That transfer happens only under an Enterprise agreement.

4.3. Under an Enterprise licence the application does not stop working when the term ends; what ends is our support and the right to platform updates.
